IU student charged with raping woman in dorm bathroom on Bloomington campus | News

LOUISVILLE, Ky. (WDRB) – A man has been charged with rape and accused of assaulting an Indiana University student while she was drunk and vomiting in a classroom. Bloomington campus bath.

According to a probable cause affidavit, the woman had been drinking alcohol with friends in a room at the Teter-Thompson residence on December 2, 2021, FOX Reports 59.

She told IU police she became drunk and decided to lie on the floor when another student, Samuel Elliott, 18, attempted to touch her inappropriately.

The woman then felt unwell and went to the bathroom to vomit, according to court documents. The woman said Elliott followed her into the bathroom and asked if they could have sex. She told him she was too drunk to make a decision.

According to the affidavit, she continued to vomit when she looked behind her and saw Elliott pull down his pants. The woman told investigators that Elliott then raped her as she continued to vomit.

The student said Elliott was interrupted by a FaceTime call from a friend of hers. She said he asked her to tell her friend that nothing had happened, then accompanied her to her dorm.

Court documents show that later that evening another friend of the woman found a used condom in the toilets where the reported attack took place. Police said he put the condom in a plastic bag and stored it in his dorm’s fridge before handing it over to investigators.

According to the Herald-TimesElliott surrendered to the Monroe County Jail after a warrant was issued for his arrest.

Although Elliott was a student at the time of the rape, an IU spokesperson said he is not currently listed on the student directory.

This is at least the second sexual assault reported on IU’s campus this school year. Kalp Patel has been charged with attempted rape in connection with an incident at Birch Hall in January 2022.
